1. The FDA has not approved Delta 8 THC Oil Drops products for safe use. They may also be marketed in ways that pose a risk to public health.

The FDA is aware that there are growing concerns about delta-8 THC products being sold online and in retail stores. The FDA has not evaluated these products and they are not safe for use in any setting. Variability in product formulations, product labeling, cannabinoid, terpene, and delta-8 THC levels are all concerns. Some of these products could be called “hemp products,” misleading consumers who may mistakenly associate “hemp” and “Non-psychoactive.” The FDA is also concerned about the rise in delta-8 THC-rich products, which are being marketed for medical or therapeutic purposes, even though they have not been approved. Unapproved products that make unsubstantiated therapeutic claims are not only illegal but can also pose a risk to consumers. These products have not been shown to be effective or safe. Patients and others may choose to use unproven treatments instead of approved therapies for serious or fatal diseases. This raises grave public health concerns.

2. FDA received reports of adverse events involving products containing Delta 8 THC Oil Drops

There were 104 adverse events reported to FDA by patients who had consumed delta-8 THC products in the period between December 1, 2020, and February 28, 2022. These 104 reports of adverse events:

  • 77% of the patients were adults, while 8% were children younger than 18 years old. 15% didn’t report their age.
  • 55% of patients required emergency intervention, such as evaluation by emergency medical service or admission to a hospital.
  • 66% of those who ingested delta-8 THC-containing foods (e.g. brownies, gummies) reported adverse reactions.
  • These adverse events include, but are not limited to, hallucinations and vomiting, anxiety, dizziness, confusion, tremors, dizziness, nausea, and loss of consciousness.

Between January 1, 2021 (i.e. the date that delta-8-THC product codes were added to the database) and February 28, 2022, 2,362 cases of exposure occurred at national poison control centers. There were 2,362 cases of exposure.

  • 58% of the participants were adults, 41% were pediatric patients under 18 years old, and 1% didn’t report their age.
  • 40% of unintentional delta-8 THC exposures were accidental. 82% of these unintentional exposures had an impact on pediatric patients.
  • 70% of patients required a health care facility assessment, with 8% resulting in admission to a critical unit. Pediatric patients comprised 45% of those who needed a health care facility assessment.
  • One case involving a pediatric patient was coded with the medical outcome of Death.

3. Delta 8 THC Oil Drops are psychoactive and intoxicating.

Delta-8 THC is similar to delta-9THC (i.e. the component that gives people the “high” from cannabis use). FDA is aware that media reports have suggested that delta 8 THC oil drops products can get consumers “high”. However, the FDA is concerned about delta-8 THC products exposing consumers to higher levels than what is naturally found in hemp cannabis raw extracts. In conclusion, the safety of these products cannot be based on historical cannabis use.

4. Delta 8 THC products can often contain potentially dangerous chemicals to make the delta-8 THC concentrations claimed on the market.

Delta 8 THC oil drops is very low in hemp. Therefore, additional chemicals are required to convert other cannabinoids, such as CBD, into delta 8 THC Oil Drops, and HHC (i.e. synthetic conversion). This process is fraught with problems.

  • To make delta-8 THC, some manufacturers might use potentially dangerous household chemicals. The final product may also be colored with additional chemicals. Due to chemicals used during the process, the final delta-8 THC product could contain potentially harmful byproducts (contaminants). There is no way to know if any other potential contaminants may be present depending on the composition and origin of the raw material. These chemicals can be dangerous if inhaled or consumed, as well as those used to synthesize delta-8 THC.
  • Unsanitary or uncontrolled manufacturing of delta-8 THC products can lead to unsafe contaminants and other potentially dangerous substances.

5. Children and pets should not be exposed to Delta8 THC Drops 

These products are being packaged and labeled by manufacturers in appealing ways for children. These products can be bought online as well as at convenience stores and gas stations. There may not be any age restrictions on these products. There have been many poison control center alerts regarding pediatric patients who were exposed. Animal poison control centers also reported a sharp increase in the accidental exposure of pets to these products. These products should be kept out of reach for pets and children.

Why does the FDA not inform the public about delta-8 THC in its products?

The FDA has provided this information to consumers due to a combination of factors. These factors include:

  • There has been an increase in reports of adverse events to the FDA and national poison control centers.
  • Online marketing, which includes marketing products online, is attractive to children.
  • There are concerns about contamination from manufacturing methods that could in some cases be used for marketed delta-8 THC products.

FDA is working closely with state and federal partners to address concerns regarding these products. The FDA also monitors the market for potential product complaints, adverse events, or other cannabis-derived products that could be of concern. FDA will notify consumers about safety and public health issues and take appropriate action if FDA-regulated products are found to be in violation of the law.
